OUR PLEDGE OF QUALITY AND GUARANTEE

• We fully guarantee each ingredient is what it says it is and is naturally occurring.
• We cannot guarantee how your body will metabolize the ingredients because we each have different metabolism, vitamin deficiencies, and biochemistry levels.  

RISK OF LOSS

Except as expressly provided under these Terms, risk of loss, title, and ownership to the products pass from the Company to the Purchaser upon shipment from a Company facility, and the Purchaser assumes the risk of loss. The Company is responsible to surrender custody of the product to the shipping company along with the shipping address and instructions provided by the Purchaser.

• The Company shall pay for the shipping expenses associated with orders shipped within the United States. You shall be responsible for the shipping costs of orders shipped internationally.
• The Purchaser is solely responsible for providing the correct shipping address and delivery instructions.
• The Company is not responsible for delays by the shipping company.
• The Company is not liable for packages delivered to the wrong address by the shipping company.
• The Purchaser shall be solely responsible for the costs associated with shipping returned products in accordance with these Terms.

RETURN & REFUND POLICY

No refunds will be issued for a partially used product or product that appears to be handled, opened, or tampered with.

Refunds will only be issued for returns of products that were:

• Purchased within 30 days from the purchase date,
• Still, retain their original factory seal,
• The Company must be notified of the Return by contacting CustomerCare@ananeoo.com, or call or text our Customer Service at (321) 872-7444
• The carrier name and tracking number for the Return must be provided to the Company in order to qualify for the refund,
• Remain in factory-quality condition as determined by the Company.

Note: Please be aware that our shipping times are subject to change.

PLEASE MAIL ALL RETURNS TO

• If the product appears defective, do not use it. Please take a photo of the defective product and send it immediately after the USPS documented arrival date to: customercare@ananeoo.com along with your order information.
• Please ensure that the shipping information on your account is complete and accurate so that your shipments will be delivered to the correct location.
• The Company is not responsible for any missing deliveries due to address forwarding or incorrect addresses provided during checkout.
• If you have not received your order, please contact customercare@ananeoo.com along with your order information within 30 days of the expected delivery date.

REFUND POLICY FOR UNOPENED BOTTLES RETURNED

• A refund will be given per factory-sealed bottle that is returned within 30 (thirty) calendar days from the date of confirmation of delivery by the USPS.
• A refund for unopened factory-sealed bottles WILL NOT be given or issued for returns initiated after 30 (thirty) calendar days from the date of confirmation of delivery by the USPS.
• The Customer is responsible for shipping the factory-sealed bottles back to the Company.
• The Customer is responsible for the cost of shipping and tracking services.
• If the Customer purchased a 90-Day Protocol with 3 (three) bottles and you choose to return 1 (one) or 2 (two) unopened bottles, you will be charged the full price of $79 per bottle with the seal broken and opened. For example, if a 3-Bottle 90-Day Protocol is sold at $207, but 2 (two) factory-sealed and unopened bottles are returned, You will be charged the full price of $79 for the 1 (one) bottle with the factory seal opened, and then refunded $128 for the 2 (two) unopened bottles that are returned. Or, if you purchase a 3-bottle 90-Day Protocol at $207, but 1 (one) factory-sealed unopened bottle is returned, you will be charged the full price of $79 per bottle with the factory seal opened and then the difference of $49 will be refunded for the 1 (one) bottle returned.

GEOGRAPHIC RESTRICTIONS

The owner of the Website is based in the State of Florida in the United States. We provide this Website for use only by persons located in the United States.

• We make no claims that the Website or any of its content is accessible or appropriate outside of the United States.
• Access to the Website may not be legal by certain persons or in certain countries.

All matters relating to the Website and these Terms, and any dispute or claim arising therefrom or related thereto (in each case, including non-contractual disputes or claims), shall be governed by and construed in accordance with the internal laws of the State of Florida without giving effect to any choice or conflict of law provision or rule (whether of the State of Florida or any other jurisdiction).

Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Website shall be instituted exclusively in the federal courts of the United States or the courts of the State of Florida, in each case located in the state and federal courts located in the Middle District of Florida, although we retain the right to bring any suit, action, or proceeding against you for breach of these Terms in your country of residence or any other relevant country. You waive any and all objections to the exercise of jurisdiction over you by such courts and to the venue in such courts.

You acknowledge and agree that you and Company are each waiving the right to a trial by jury or to participate as a plaintiff or class member in any purported class action or representative proceeding.

ARBITRATION

At Company’s sole discretion, it may require you to submit any disputes arising from these Terms or use of the Website, including disputes arising from or concerning their interpretation, violation, invalidity, non-performance, or termination, to final and binding arbitration under the Rules of Arbitration of the American Arbitration Association applying Florida law.

The arbitration will be administered by the American Arbitration Association (“AAA”) in accordance with the Commercial Arbitration Rules and the Supplementary Procedures for Consumer-Related Disputes (the “AAA Rules”) then in effect, except as modified by this section.

The arbitrator will be either a retired judge or an attorney licensed to practice law and will be selected by the parties from the AAA’s roster of arbitrators. If the parties are unable to agree upon an arbitrator within seven (7) days of delivery of the Demand for Arbitration, then the AAA will appoint the arbitrator in accordance with the AAA Rules.

Unless you and Company otherwise agree, the arbitration will be conducted in the county where you reside. If your claim does not exceed $10,000, then the arbitration will be conducted solely on the basis of the documents that you and the Company submit to the arbitrator, unless you request a hearing or the arbitrator determines that a hearing is necessary. If your claim exceeds $10,000, your right to a hearing will be determined by the AAA Rules. Subject to the AAA Rules, the arbitrator will have the discretion to direct a reasonable exchange of information by the parties, consistent with the expedited nature of the arbitration.

The arbitrator will render an award within the time frame specified in the AAA Rules. The arbitrator’s decision will include the essential findings and conclusions upon which the arbitrator based the award. Judgment on the arbitration award may be entered in any court having jurisdiction thereof. The arbitrator’s award of damages must be consistent with the terms of the “Limitation of Liability” section above as to the types and amounts of damages for which a party may be held liable. The arbitrator may award declaratory or injunctive relief only in favor of the claimant and only to the extent necessary to provide relief warranted by the claimant’s individual claim. If you prevail in arbitration, you will be entitled to an award of attorneys’ fees and expenses, to the extent provided under applicable law. The company will not seek, and hereby waives all rights it may have under applicable law to recover, attorneys’ fees and expenses if it prevails in arbitration.

Your responsibility to pay any AAA filing, administrative and arbitrator fees will be sole as set forth in the AAA Rules. However, if your claim for damages does not exceed $75,000, Company will pay all such fees unless the arbitrator finds that either the substance of your claim or the relief sought in your Demand for Arbitration was frivolous or was brought for an improper purpose (as measured by the standards set forth in Federal Rule of Civil Procedure 11(b)).

LIMITATION ON TIME TO FILE CLAIMS

ANY CAUSE OF ACTION OR CLAIM YOU MAY HAVE ARISING OUT OF OR RELATING TO THESE TERMS OR THE WEBSITE MUST BE COMMENCED WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES; OTHERWISE, SUCH CAUSE OF ACTION OR CLAIM IS PERMANENTLY BARRED.

WAIVER AND SEVERABILITY

No waiver by the Company of any term or condition set out in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of the Company to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.

If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.

ENTIRE AGREEMENT

The Terms and our Privacy Policy constitute the sole and entire agreement between you and the Company regarding the Website and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Website.
